Terms of service

These Terms & Conditions govern the sale of goods by Homeline Furniture Pty Ltd (ABN 36 683 894 322) ("Homeline Furniture", "we", "us", "our") to any person or entity purchasing goods ("the Customer", "you"). By placing an order, you acknowledge that you have read, understood, and agree to be bound by these terms.

1. Definitions & Application

1.1 "Goods" means the furniture and related products supplied by Homeline Furniture. "Order" means a request by the Customer to purchase Goods that has been accepted by Homeline Furniture.

1.2 These terms apply to every Order however it is placed, including online through the Homeline Furniture website, in store, or by phone or email, and prevail over any other terms the Customer seeks to impose or incorporate. No variation to these terms is binding unless agreed by Homeline Furniture in writing.

1.3 Nothing in these terms excludes, restricts, or modifies any guarantee, right, or remedy conferred on the Customer by the Australian Consumer Law ("ACL") that cannot lawfully be excluded.

2. Orders & Acceptance

2.1 An Order constitutes an offer by the Customer to purchase Goods in accordance with these terms. No Order is accepted, and no contract of sale is formed, until Homeline Furniture confirms acceptance or dispatches the Goods, whichever occurs first.

2.2 Homeline Furniture may decline or cancel any Order affected by pricing error, stock unavailability, or system error, and will refund any amount paid in respect of the cancelled Order.

3. Prices & Payment

3.1 The Customer may secure Goods with a deposit and pay the balance at a later date. Title to and possession of the Goods will not pass, and the Goods will not be released or dispatched, until the purchase price has been paid in full.

3.2 Deposits are non-refundable where the Customer cancels the Order, except as required by the ACL. Where Homeline Furniture cancels the Order or is unable to supply the Goods, the deposit will be refunded in full. Payment of a deposit secures the Order and constitutes acceptance of these terms.

3.3 All prices are stated in Australian dollars and are inclusive of GST. Delivery fees, rubbish-removal fees, and postage are additional and are shown before payment.

3.4 Where a genuine pricing error is identified, Homeline Furniture may, at its discretion, honour the displayed price or contact the Customer to confirm the corrected price before proceeding. Where the corrected price is not accepted, the Order will be cancelled and any amount paid refunded.

3.5 Sale, promotional, and clearance prices apply only for the stated promotional period and only to new Orders placed within that period. Promotional prices cannot be applied retrospectively to earlier Orders, cannot be combined with any other offer unless expressly stated, and promotional discounts do not apply to delivery fees, surcharges, or postage unless expressly stated. Where a promotion is subject to available stock, it ends when that stock is exhausted.

3.6 Quotes, including delivery quotes and any other written or verbal quote, are estimates based on prices, stock, and delivery costs current at the time they are given, and prices may change after a quote is issued. A quote is valid for fourteen (14) days from the date it is given unless it states a shorter period; a delivery quote is valid only for the delivery date or timeframe quoted. After a quote expires, or where the delivery date or address changes, a new quote is required and the prevailing prices apply. A quote does not reserve stock or constitute an Order until accepted and paid for (or a deposit placed) within the validity period.

4. Cancellations

4.1 All sales are final. Homeline Furniture does not accept returns or exchanges for change of mind, wrong selection, or unsuitability. This clause does not affect the Customer's rights under the ACL in respect of Goods with a manufacturing defect, which are governed by clause 11.

4.2 Where the Customer cancels an Order after payment, a cancellation fee equal to thirty percent (30%) of the total Order value applies, whether or not the Goods have been dispatched. This fee is a genuine pre-estimate of the costs Homeline Furniture incurs in processing, holding, and restocking the Order, and does not apply where Homeline Furniture cancels the Order or where the Goods are rejected under clause 11 or the ACL.

4.3 Deposits are forfeited where the Customer cancels the Order, in accordance with clause 3.2. Clause 4 does not apply to Goods rejected on the basis of a manufacturing defect, which are governed by clause 11 and the ACL.

5. Products & Descriptions

5.1 All descriptions, specifications, photographs, dimensions, and colours are provided as accurately as reasonably practicable and are indicative only. Variations may occur due to lighting, photography, screen display, and manufacturing processes.

5.2 Leather and fabric Goods may exhibit natural variation in grain, tone, and texture. Marble and timber Goods may exhibit natural variation in veining, grain pattern, colour, and markings, and no two pieces are identical; the Goods delivered may differ in pattern from display pieces, photographs, and other pieces of the same product. Such variation is inherent to natural materials and does not constitute a defect.

5.3 Some product images may be enhanced using artificial intelligence tools to improve visual presentation (such as sharpness, lighting, or background). Such enhancement does not alter the colour, structure, materials, or design of the Goods depicted, and images remain indicative only in accordance with clause 5.1.

5.4 Leather Goods are offered in two constructions. Goods described as "full leather" are upholstered in genuine leather on all surfaces, including the back and sides. Goods described as "leather" are upholstered in genuine leather on every seating and contact surface, with a matched man-made leather on the back and sides that protects the hide from rubbing against walls. The construction applicable to each Good is stated on its product page, and neither construction constitutes a defect or misdescription.

5.5 Powered Goods, including electric recliners and other electrically operated furniture, require access to mains power to operate. The number of power points required is stated on the relevant product page; battery packs are available as an alternative where stated and are sold separately. For modular Goods, each powered module requires its own power point or battery pack, and adding or removing modules changes the number required. The Customer is responsible for ensuring suitable power points are available at the intended location. Delivery and assembly do not include any electrical work.

6. Delivery & Access

6.1 The Customer must ensure that access to the delivery address is clear and safe, that driveways, entryways, hallways, stairs, and lifts are unobstructed, and that a person aged 18 years or over is present to receive and sign for the delivery.

6.2 The Customer is solely responsible for confirming that the Goods will fit through all access points to the intended location. Homeline Furniture is not obliged to modify, dismantle, or force Goods to achieve access, and is not liable where Goods cannot be delivered due to inadequate access.

6.3 Delivery timeframes are estimates only and are not guaranteed. Homeline Furniture is not liable for delays arising from traffic, weather, freight carriers, suppliers, or access issues. A delay does not of itself entitle the Customer to cancel the Order; however, where a delay is within Homeline Furniture's control and is so significant that it amounts to a major failure under the ACL, the Customer retains their ACL remedies.

6.4 Homeline Furniture may engage third-party delivery contractors to perform any delivery on its behalf, including deliveries within South East Queensland. Where it does, those contractors deliver, assemble, and place the Goods to the same standard as Homeline Furniture's own team, and these terms apply to the delivery in the same way.

6.5 Standard furniture deliveries are made Monday to Friday.

6.6 Removal of packaging and rubbish is not included in delivery. Packaging will be left with the Customer to dispose of, unless the Customer purchases the rubbish-removal service at checkout, in which case Homeline Furniture will remove and dispose of the packaging for the Goods delivered.

6.7 Certain small items, including but not limited to cushions, throws, prints and wall art, candles, care kits, and similar décor, are dispatched by standard post or courier and can be shipped across Australia. Postage for these items is calculated and charged at checkout, and does not require the Customer to contact Homeline Furniture. These items are delivered without assembly or placement, are not covered by the standard South East Queensland delivery-and-assembly service, and are not subject to the Delivery Fit Guide. Where an order contains both furniture and postable items, the postable items may be delivered together with the furniture at no additional postage.

6.7A Posted items are carried by Australia Post or courier, and their delivery timeframes are estimates given by the carrier, not by Homeline Furniture. The Customer is responsible for supplying a correct and complete delivery address; where an item is returned or lost because the address supplied was wrong or incomplete, re-dispatch is at the Customer's cost. Where a posted item arrives damaged or is lost in transit, the Customer should contact Homeline Furniture, which will pursue the matter with the carrier and provide the remedies required by the ACL.

6.8 Delivery, assembly, and placement are provided within Homeline Furniture's South East Queensland service area. For deliveries beyond that area, delivery is arranged by quote and assembly may not be available; where assembly is not available, the Goods are delivered without assembly or placement. Homeline Furniture will confirm what is included at the time of quoting.

6.9 Marble and natural-stone Goods, and any Goods identified on the product page as heavy (marked with a red dot), are delivered to ground level only. Carrying such Goods up stairs presents a safety hazard, and Homeline Furniture and its contractors will not carry them up stairs or between levels under any circumstances. Any movement of such Goods beyond ground level is arranged by the Customer, at the Customer's cost and sole risk.

6.10 Prior to completion of delivery or assembly, the delivery team will test all mechanisms and moving or powered parts of the Goods, including, without limitation, recliner and sofa-bed mechanisms, lights and electrical components, storage drawers, hinges, and lift-up storage, and will note any fault or damage identified. The Customer will then be asked to inspect the Goods and sign a delivery completion form confirming the Goods are in good working order, free of damage, and assembled to the Customer's satisfaction. The signed form is relied on as evidence of the condition of the Goods at handover in respect of any later claim of damage or fault said to have existed at delivery, other than faults that could not reasonably have been identified on inspection at handover. Nothing in this clause limits the Customer's rights under the ACL in respect of manufacturing defects.

6.11 Where a delivery cannot be completed because no person aged 18 years or over is present, or because access is obstructed or unsafe, the delivery will be rescheduled and a redelivery fee equal to the original delivery fee applies, reflecting the cost to Homeline Furniture of the failed attempt.

6.12 The Customer may reschedule a booked delivery by giving at least two (2) business days' notice at no charge. Where less notice is given and the delivery run cannot reasonably be re-planned, a rescheduling fee of up to fifty percent (50%) of the delivery fee may apply.

6.13 Assembly means the assembly of the Goods themselves and their placement in the Customer's chosen room at the delivery address. It does not include fixing or mounting Goods to walls or other structures, anchoring, electrical or plumbing work, the hanging of wall art, or any modification to the Customer's premises. Any such work is arranged by the Customer at the Customer's cost.

7. Pickup & Collection

7.1 Goods may be collected from Homeline Furniture's showroom or warehouse. Goods must be paid in full prior to collection, and the Customer must present a copy of the invoice and valid photographic identification.

7.2 The Customer is solely responsible for providing a suitable vehicle, adequate assistance, and appropriate restraints to load and secure the Goods. For safety and liability reasons, Homeline Furniture staff and contractors do not lift Goods into vehicles and do not load, strap, tie down, restrain or otherwise secure Goods or loads.

7.3 Risk in the Goods passes to the Customer upon collection. Homeline Furniture is not liable for any loss or damage occurring after the Goods leave its premises, except where the loss or damage arises from a manufacturing defect covered by clause 11 or the ACL. Paid Goods will be held for collection for up to thirty (30) days, after which Homeline Furniture may arrange delivery or storage at the Customer's cost.

7.4 Where collected Goods require assembly by the Customer, assembly must be carried out strictly in accordance with the instructions provided. Homeline Furniture is not liable for any damage to the Goods, injury, or loss arising from incorrect assembly, failure to follow the instructions, or the use of unsuitable tools or methods (including, without limitation, electric drills or other power tools), except where the damage arises from a manufacturing defect covered by clause 11 or the ACL.

8. Risk & Title

8.1 Risk in the Goods passes to the Customer upon delivery or collection. Title in the Goods does not pass to the Customer until Homeline Furniture has received payment in full.

8.2 Upon delivery or collection, full responsibility for the Goods transfers to the Customer. Homeline Furniture is not liable for any damage, injury, or loss caused by or to the Goods after delivery or collection, including, without limitation, any Goods that tip, fall, or are moved after delivery or collection, except where the damage arises from a manufacturing defect covered by clause 11 or the ACL. The Customer is responsible for ensuring Goods are positioned safely and, where appropriate, anchored.

9. Floor Stock & Clearance

9.1 Floor stock and clearance Goods are sold on an "as-is" basis. The Customer accepts any cosmetic imperfections identified or reasonably apparent at the time of purchase, and any applicable warranty is limited to structural or mechanical faults. Nothing in this clause excludes the consumer guarantees under the ACL, which do not apply to defects specifically drawn to the Customer's attention before purchase.

10. Custom & Special Orders

10.1 Custom and special Orders are manufactured to the Customer's specifications, with lead times quoted as estimates only and subject to factors outside Homeline Furniture's control.

10.2 Once production of a custom or special Order has commenced, the Order may not be cancelled or refunded, except to the extent required by the ACL.

11. Warranty & Claims

11.1 Goods are covered by a warranty given by Homeline Furniture, with the period and cover stated on the relevant product page. All warranty claims are made to and handled by Homeline Furniture. Warranties apply to normal domestic use only. Use of Goods in any commercial, hospitality, rental, office, or other non-domestic setting voids the warranty immediately and in full.

11.2 To make a warranty claim, the Customer must provide proof of purchase and clear photographic or video evidence of the fault. Where no manufacturing fault is identified, a call-out or inspection fee may apply.

11.3 Where a fault is confirmed, Homeline Furniture will remedy the fault by repair or replacement of the Goods, or supply of equivalent Goods, at its election. Homeline Furniture does not otherwise offer refunds; a refund is provided only where, and to the extent, the ACL requires one, including where the failure amounts to a major failure.

11.4 These warranties are in addition to, and do not limit, the Customer's rights under the ACL.

12. Limitation of Liability

12.1 To the maximum extent permitted by law, Homeline Furniture's liability for any breach of these terms or any statutory guarantee is limited, at Homeline Furniture's election, to the repair or replacement of the Goods, the supply of equivalent Goods, or the refund of the price paid. This limitation does not apply where the Goods are of a kind ordinarily acquired for personal, domestic, or household use and the failure amounts to a major failure under the ACL, in which case the Customer is entitled to the remedies the ACL provides.

12.2 To the extent permitted by law, Homeline Furniture is not liable for any indirect, consequential, or economic loss, or for damage to Goods arising after delivery or collection, including damage caused by the Customer's own assembly, handling, misuse, or neglect.

13. Force Majeure

13.1 Homeline Furniture is not liable for any failure or delay in performing its obligations to the extent the failure or delay is caused by events beyond its reasonable control, including natural disasters, flood, fire, severe weather, epidemics, industrial action, supplier or carrier failure, and government restrictions. Where such an event continues for more than ninety (90) days, either party may cancel the affected Order and any amount paid for undelivered Goods will be refunded. This right of cancellation applies only to Goods located in Australia at the time of cancellation, and does not apply to Goods in transit to Australia.

14. General

14.1 If any provision of these terms is found to be void, unenforceable, or in conflict with the ACL, that provision is severed to the extent necessary and the remaining provisions continue in full force.

14.2 These terms, together with the Order confirmation and the policies published on this website (including the Delivery Fit Guide, Returns, and Privacy pages), constitute the entire agreement between the parties in respect of the Goods.

14.3 A failure by Homeline Furniture to enforce any provision of these terms is not a waiver of that provision or of any right to enforce it later.

15. Governing Law

15.1 These terms are governed by the laws of the State of Queensland and the Commonwealth of Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland.
